How can I know which lawyer to select?

Before you hire a lawyer, you should do a little research. Ask for information about the lawyer’s education, training and experience. Ask the lawyer to tell you about any cases he/she has handled which are similar to your case. Review the fee contract with the lawyer to e sure you understand how the fee and costs will be handled whether you win or lose the case. Find out if your lawyer will be handling the case alone or if other lawyers outside the firm will be assisting, in which case, you would want to know what the fee arrangements will be.

Do I need more than one lawyer? I already have a lawyer who handles my family matters.

You can be sure that the lawyers representing the insurance company will have a great deal of experience aggressively defending claims since every insurance company wants to keep its loss column totals as low as possible. You will want to be represented by a lawyer who has experience and success in handling personal injury cases.

Will I get the personal attention I need from your law firm?

As a client of our firm, your calls are always welcomed and you will receive calls on a regular basis to check on your progress and to keep you up-to-date.

If I call for a consultation, what information should I have ready for you?

When you call, you will be asked to describe the incident that resulted in your injury. Names and dates are important as well as exact location of the incident. After collecting initial information, the secretary will connect you with an attorney or have the attorney return your call to discuss your case.

What will happen during my first appointment with your firm?

When your appointment is scheduled, you will be given a list of things to bring with you which will help us prepare your file and acquire all the necessary reports, etc. When you arrive at McKinney, Braswell & Butler, you will meet with our legal staff to discuss your case in detail as well as our fee structure and procedures. Of course, this consultation is always free.

Do I have to pay you a retainer to handle my case?

Our cases are handled on a contingent fee contract. This means that we don’t get paid until and unless you make a recovery. Full details of the fee agreement that you will have with our firm will be explained to you in detail before you sign the contract.

What about expenses involved in pursuing this case?

McKinney, Braswell & Butler will advance expenses incurred during our representation. If and when the case reaches a successful conclusion, the costs we have expended will be returned to us out of your settlement and will be in addition to the fee charged.

How do I know you can win my case?

Obviously, there are no guarantees associated with any lawsuit or claim. However, we have a strong commitment to excellence. We can assure you that we will do our very best to provide you with outstanding legal representation as we prosecute your case and if necessary, prepare your case for trial.

If we have to go to trial will you help me prepare?

It has been our experience that most cases are resolved prior to going to trial. Nevertheless, we believe in being prepared should the parties be unable to reach an agreement. If it becomes necessary to go to trial, our lawyers will spend whatever time is necessary with you so that you will know exactly what to expect.

How is the decision made whether to accept a settlement or take my case before a jury?

Our lawyers will discuss with you all the pros and cons of trying your case versus setting it for trial. We will certainly advise you as to whether a settlement offer is a good one and what we feel the odds are, but ultimately the decision will be yours.

How long will it take to resolve my case?

Much will depend on your medical condition, length of your treatment and when the case can be set for trial. We will actively pursue your claim, and our intent will be to resolve it as quickly as possible, but we will be watching out for your best interests, taking into consideration all of the complex components of your particular case.
